Terms of Use Agreement

Welcome to WhenWeAll.org. This website is operated by Alliance for a Better Minnesota, a Minnesota nonprofit organization ("we," "us," "our," "ABM"). The following terms and conditions (together with any documents referred to in them) (collectively, these Terms") apply to your use of our website and any petition or other services offered at www,WhenWeAll.org or through any mobile application we develop utilizing the tools from the website (collectively, our "Petition Platform"), which is owned and operated by us.

Your use of our Petition Platform, either as a petition creator or signer, means that you accept and agree to these Terms of Use. If you do not agree to these Terms or our Privacy Policy, do not use or access the Petition Platform.

We may revise and update these Terms of Use from time to time in our sole discretion, and will post any updates to the Terms of Use on the Petition Platform. Any new petition you create will be governed by our then-current form of the Terms. Your continued use of our Petition Platform, or any other service provided through WhenWeAll.org, means that you accept and agree to the modified Terms of Use.

As an initial matter, our Petition Platform is a space for people who want to create a more progressive world. At times we may disagree with what is and isn't progressive - that's healthy, but we reserve the right to remove any campaign that is not considered progressive. We've included more details under "Petition Campaign Standards."

Petition Platform Campaign

The Petition Platform allows you to create and circulate a petition of interest to you or your organization. The treatment of all information you provide to us on the Petition Platform is governed by our Privacy Policy. Please review the terms of our Privacy Policy regarding the treatment of personal information, and how we collect, use, manage, disclose and accumulate information. To create a campaign on the petition platform ("Petition Campaign"), you must provide information to set up an account with us, including your first and last name or your organization's name, your position (if applicable), email address, user name and password ("Account"). You are responsible for keeping your account information secure. You may deactivate your account by going into your account settings under "My Account" and deleting your account. By registering a Petition Campaign, you agree that you have full legal authority to register with your name, organization, email address and password.

When setting up a Petition Campaign, we will ask you to provide information such as the company, legislative body or other individual you are petitioning, what actions you want them to take, a description of the importance of the petition, and the location of the campaign. You may also provide photos or other graphics related to your Petition Campaign. All of the information and images you submit related to your Petition Campaign is collectively referred to as "Petition Content."

By using the Petition Platform, registering a Petition Campaign, and submitting Petition Content you represent and warrant that: (1) all Account Information and Petition Content is truthful, accurate, current and owned by you or your organization, (2) you will maintain the accuracy of your Account and any Petition Content; and (3) your use of the Petition Platform does not violate any applicable laws or regulations.

Petition Campaign Standards

The Petition Platform is to provide a progressive voice for various individuals and organizations to advocate for community or legislative initiatives. We will not grant accounts to or use of the Petition Platform to any individual candidate or for direct votes or support for a specific elected or appointed official. Your use of the Petition Platform and all Petition Campaigns must be for non-commercial use only and may not be used for direct election or fundraising purposes.

Our goal is to provide the Petition Platform to assist individuals and organizations to engage in progressive, grassroots, digital politics. We have the sole right to accept or reject your Petition Campaign. In this section, we try to cover all the grounds for our rejections, but we can reject your Petition Campaign because it just does not fit our mission and the goal of WhenWeAll.org. We know enough to know that we may not be able to list all those grounds in this small section.

Upon setting up a Petition Campaign, the information you submitted will be review by us prior to posting the Petition Campaign, usually within one business day, and we will contact you with approval or rejection of your proposed Petition Campaign. All users must be respectful and authentic in their uses of the Petition Platform. Beyond the general restrictions stated above, a Petition Campaign may be rejected for any of the following reasons:

  • It is not a progressive goal (i.e., advocates against gay rights, climate change, women's rights, minority rights, etc.);
  • It includes inappropriate, hateful, defamatory, libelous or slanderous content;
  • It infringes upon the third party intellectual property rights of another (including graphics or other uploaded content);
  • It advocates hate, violence, abuse, threats, harms against any group or otherwise seen as harassment;
  • It solicits funds for or contributions to any candidate;
  • It discloses confidential or private information;
  • It is patently offensive to any community standard or particular community; or
  • Is otherwise inconsistent with the goals, objectives, and purpose of WhenWeAll.org.

We will not continuously review Petition Campaigns for content and reserve the right at any time to remove a Petition Campaign that is found to violate our Petition Campaign Standards. Any content that violates these Standards may be removed or may result in the suspension or deactivation of your Account. We may remove commercial advertisements or links to other websites without notice to you. We also provide users with the ability to "flag" any Petition Campaigns as inappropriate and we will review any "flags" posted by other users of the Petition Platform.

Petition Campaign Signatures and Information Practices

Upon creation and approval of your Petition Campaign, you will be able to provide links to your Petition Campaign to collect support for your initiative. In collecting signatures, you are limited to collecting only the signer's first name, last name, email address and postal code. In some instances, we may allow collection of mailing addresses and phone numbers with prior consent from us. Only the first name and last initial of the signatories will appear on the Petition Campaign landing page and by signing a petition, all signatories agree to these Terms and our Privacy Policy, The information for all signatories will automatically be collected by Alliance for a Better Minnesota and www.WhenWeAll.org. Each signatory will be given the option of whether he or she would like their information to be provided to you or your organization for further communication about your initiatives beyond the Petition Campaign. As an organizer of the Petition Campaign, you will receive the first name, last name, email address and postal code of your signatories and may contact them regarding the specific Petition Campaign they have signed. You may not add their names or email addresses to any separate database unless specifically authorized through the opt-in process. For signatories on a specific Petition Campaign, we have no control over the content of the messages sent by the Petition Campaign organizers unless reported to use for violations of these Terms. As a Petition Campaign creator, there is no assumption that users will opt-in to providing their information to you to be used beyond the Petition Campaign and you may not reverse engineer or otherwise attempt to collect a signatory's information for further use beyond the Petition Campaign.

As a signatory, your information will be collected, stored and used in accordance with our Privacy Policy and may be shared with a sponsoring individual or organization related to a Petition Campaign. You agree that by submitting your name, email address and postal code, the information you are submitting is accurate, truthful and has not been submitted on behalf of anyone else or does not include fictitious information.

Account Inactivity or Deactivation of Your Account

By registering for a Petition Campaign, you authorize us, Alliance for a Better Minnesota, to communicate with you regarding the content or status of your Petition Campaign and otherwise utilize your information pursuant to our Privacy Policy. We may suspend or deactivate your Account or Petition Campaign or cease providing you with access to our Petition Platform or Services including, but not limited to, if we reasonably believe: (1) you have violated these Terms, (2) your Petition Campaign is modified such that it violates these Terms or our Petition Standards; (3) you create a risk or potential legal issues for us, or (4) we, for any reason, can no longer provide the Services or access to the Petition Platform to you. If we suspend or deactivate your account, we will notify you through the email address associated with your Account and may provide you, in our sole discretion, with the opportunity to correct the deficiencies of your Petition Campaign.

Use of Petition Platform, Petition Campaigns and Petition Content

By providing your information to a Petition Campaign, you agree to allow the Petition Campaign creator to use your information for the purpose of communicating with you about the Petition Campaign and as otherwise described in our Privacy Policy. The Petition Platform and any Petition Campaign and all Petition Content is provided AS IS and used only in connection with the purposes of the Petition Platform and WhenWeAll.org and may not be downloaded, copied, reproduced, distributed, sold, licensed or otherwise exploited for any purpose inconsistent with the Petition Platform's purpose without our prior written consent. Other than our initial review of your Petition Content, we do not guarantee the accuracy, integrity, or quality of any Petition Campaign on the Petition Platform. You understand that by using the Petition Platform, you may access information that you do not agree with or may be objectionable to you and you agree that we are required to take no action regarding Petition Content or Petition Campaigns based on your objection of certain content, ideas or campaigns. You may access your Account, Petition Content and Petition Campaigns only as permitted under these Terms. We reserve all rights not expressly granted in these Terms.

Once a Petition Campaign has been created, each organizer will be sent an email with a specific URL ("Petition Campaign Landing Page") to share and promote the Petition Campaign. From the Petition Campaign Landing Page, you will also have the ability to promote your Petition Campaign through radio buttons to various social media platforms, such as Facebook and Twitter. To share the Petition Campaign through these social media platforms, you must have a valid account with each platform and comply with all terms and conditions listed on those websites or platforms.

You agree not to circumvent, disable or otherwise interfere with any features related to the Petition Platform, such as security, access to other users' information or account or otherwise violate the purpose of the Petition Platform. You agree to abide by all rules of content when using the Petition Platform and agree, at a minimum, to not do any of the following:

  • Collect usernames or email addresses from any other user of the site;
  • Fundraise or solicit contributions for any candidate or organization, other than as allowed through these Terms;
  • Use the Petition Platform in any way that violates applicable laws and regulations
  • Abuse, stalk or otherwise harass another user or any Petition Campaign creator;
  • Partake in any act that would be considered "trolling" on the Petition Platform or links to any Petition Campaign;
  • Upload or post any viruses, Trojan horses, worms, spyware, cancel bots or any other horrible online tool that will damage or attach to any aspect of the Petition Platform or any individual utilizing the Petition Platform;
  • Collect information online from individuals under 13;
  • Include links to personal or commercial websites that are not in keeping with these Terms;
  • Provide information that is false or misleading or otherwise mislead anyone reading a Petition Campaign; or
  • Otherwise violate the tenant of these Terms or WhenWeAll.org.

We reserve the right but do not monitor, endorse, edit or screen any Petition Content, once posted. Petition Content and individual Petition Campaigns do not necessarily reflect the views or opinions of Alliance for a Better Minnesota. You acknowledge, understand and agree that we shall neither assume nor have any responsibility or liability for any Petition Campaigns, Petition Content or for any claims, damages, injury or losses resulting from the use of the Petition Platform.

Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use www.WhenWeAll.org, the Petition Platform and our Services. As a condition of your use of the Petition Platform, you warrant that you will not use the Petition Platform or our Services for any purpose that is unlawful or prohibited by these Terms. You may not use the Petition Platform in any manner which could damage, disable, overburden, or impair the Petition Platform or interfere with any other party's use and enjoyment of the Petition Platform. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Petition Platform.

By submitting Platform Content through the Petition Platform, you represent and warrant that you have all intellectual property rights in the Petition Content and automatically grant to us a royalty-free, worldwide, fully paid, perpetual irrevocable, nonexclusive right to use, reproduce, distribute, modify, adapt, and publicly display your Petition Content within the Petition Platform as permitted by you through your interactions on and through the Petition Platform and (ii) use and reproduce (and to authorize third parties to use and reproduce) any of your Petition Content and your identity in any or all media throughout the world for the purpose of transmitting or publicizing any Petition Campaign. You also grant to us the perpetual and irrevocable right to delete any or all of your Petition Content or Petition Campaign from the Petition Platform and grant to us a royalty-free, fully paid-up, perpetual, irrevocable, non-exclusive right and license to copy, analyze, and use any of your Petition Content as we may deem necessary or desirable for purposes of debugging, testing, and/or providing support services in connection with the Petition Platform. Further, you agree to grant to Alliance for a Better Minnesota a royalty-free, worldwide, fully paid-up, perpetual, irrevocable, nonexclusive, sublicensable right and license to exercise the copyright, publicity, and database rights you have in your Account, including any data or other information generated by your Account activity, Petition Campaigns, Petition Content or other information posted by you to the Petition Platform, in any media now known or not currently known, in accordance with our Privacy Policy.

All content included as part of the Petition Platform, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Petition Platform, is our property or the property of our suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.

You will not modify, public, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Petition Platform. Our content is not for resale. Your use of the Petition Platform does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without our express written permission. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to our intellectual property or our licensors except as expressly authorized by these Terms.

Digital Millennium Copyright Act Policy

Our policy is to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act ("DMCA"). Submitting a claim of copyright infringement, however, is a serious claim and before you send us notification, you should attempt to reach out to the sponsor of the Petition Campaign and may work with that individual regarding the infringing content.

If you believe that any content on the Petition Platform, including content contained in an individual Petition Campaign violates the copyrights of another individual, you may send it to: info@abetterminnesota.com . To submit a claim, you must identify your full name, mailing address and phone number, a description of the copyrighted work that has been infringed, a description of the content on the Petition Platform that infringes upon the copyright, and a declaration that: (i) you, in good faith, believe the information is infringing on the copyright of a third party, (ii) the information you include in your notice is accurate, and (iii) you are authorized on behalf of the copyright owner to submit the claim. You may not submit a copyright claim on behalf of another individual or organization with which you have no affiliation.

Links to Other Websites and Connecting Through Social Media

The Petition Platform and individual Petition Campaigns may contain hyperlinks to websites operated by third parties. We do not control such websites and will not be responsible for their content or for any breach of contract or any intentional or negligent action on the part of such third parties, which results in any loss, damage, delay or injury to you or your companions. We are not responsible for the accuracy of opinions expressed in the Petition Campaigns or any linked websites, whether in the Petition Campaigns or otherwise on the Petition Platform, and such websites and links are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked website on the Petition Platform does not imply or constitute approval or endorsement of the linked website by us. If you decide to leave the Petition Platform to access these third-party sites, you do so at your own risk. All rules, policies (including privacy policies) and operating procedures of websites operated by third parties will apply to you while on such sites. We are not responsible for information provided by you to third parties.

Individuals accessing your Petition Campaign may be able to directly link to the Petition Campaign through abbreviated URLs on social media sites such as twitter and Facebook. When creating your Petition Campaign, you cannot disable these features and cannot control the sharing of your Petition Campaign, once created. We cannot control any content added by individuals to any social media site regarding your Petition Content or Petition Campaign.

In the future, you may also be able to connect your Account to third party applications, such as Facebook and Twitter. By connecting through such third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party applications). If you do not want information to be shared, do not use those sites or that feature.

Indemnification

You agree to indemnify, defend and hold harmless Alliance for a Better Minnesota, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising our of your use of or inability to use the Petition Platform, any claim that your Petition Content or Petition Campaign violates the intellectual property rights of a third party, any use or publicizing of the Petition Campaign or any portion of the Petition Content, your violation of these Terms or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. We reserve the right, at our own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with us in asserting any available defenses.

Electronic Communications

Visiting www.WhenWeAll.org or sending emails to use constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Petition Platform, satisfy any legal requirement that such communications be in writing. To opt out of receiving an email from us or, where applicable, the creator of a Petition Campaign, follow the "unsubscribe" link on the email to change your user preferences. There are certain system generated and legal notices that you cannot opt out of without deactivating your account.

Warranty and Limitation of Liability

THE PETITION PLATFORM AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE PETITION PLATFORM INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. ALLIANCE FOR A BETTER MINNESOTA ANDOR ITS SUPPLIES MAY MAKE IMPROVEMENTS AND/OR CHANGES TO THE PETITION PLATFORM AT ANY TIME.

ALLIANCE FOR A BETTER MINNESOTA AND/OR ITS AFFILIATES OR SUPPLIES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE PETITION PLATFORM FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. ALLIANCE FOR A BETTER MINNESOTA AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REFARD TO THE PETITION PLATFORM, INDIVIDUAL PETITION CAMPAIGNS, ALL PETITION CONTENT, AND RELATED INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ALLIANCE FOR A BETTER MINNESOTA AND/OR ITS AFFILIATES OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPCIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE PETITION PLATFORM, WITH THE DELAY OR INABILITY TO USE THE PETITION PLATFORM, ANY INDIVIDUAL PETITION CAMPAIGN OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE PETITION PLATFORM, THE APPLICATION OR OTHERWISE ARISING OUT OF THE USE OF THE PETITION PLATFORM OR THE APPLICATION, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF ALLIANCE FOR A BETTER MINNESOTA OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE PETITION PLATFORM, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE PETITION PLATFORM.

Governing Law, Venue and Jurisdiction

The existence of the Petition Platform is not intended and should not be construed to mean that we are conducting business in all states of the United States of America, or that we consent to submit to the person jurisdiction of the state or federal courts in any state in the United States, except the State of Minnesota. These Terms shall be treated as though it were executed and performed in Minnesota, and shall be governed by and construed in accordance with the laws of the State of Minnesota and the laws of the United States without regard to conflict of law principles. You agree that any claim or dispute you may have arising out of or related to the Petition Platform or Application including, without limitation, your use of the Site, your use of any Applications, the Site's or Application's Materials, your information provided to the Petition Platform, and/or these Terms of Use, the Privacy Policy, and any legal notices on this Petition Platform must be instituted within one (1) year after the claim arose (if multiple claims, from the date the first claim arose) or be forever waived and barred. You agree that you will bring any claims in, and submit to the exclusive jurisdiction of, the state and federal courts located in the County of Hennepin, in the State of Minnesota.

Miscellaneous Terms

These Terms of Use, together with our Privacy Policy and Community Guidelines, are the entire agreement between you and us related to your use of the Petition Platform.
